El TS ratifica la validez de Filologia Catalana para las oposiciones docentes
El Supremo ha dictado una sentencia en la que ratifica la validez del título de catalán para acreditar los conocimientos de valenciano en las procesos selectivos.

De esta forma, el Alto Tribunal desestima el recurso de casación interpuesto por la Generalitat valenciana contra una sentencia de 12 de mayo de 2005 del Tribunal Superior de Justicia de la Comunitat Valenciana (TSJCV) dictada a raíz de un recurso interpuesto por el sindicato STEPV-Iv contra las órdenes de 23 abril de 2003 que convocaban las oposiciones al cuerpo de maestros y enseñanza secundaria, Escuelas Oficiales de Idiomas, Formación Profesional y Música y Artes Escénicas que no contemplaba la titulación de Filología Catalana como eximente de las pruebas de valenciano.

La resolución judicial, que recoge Europa Press, señala que el Tribunal Supremo ya había admitido anteriormente -en una sentencia de 2006- que no existe razón jurídica alguna que permita sostener que la Licenciatura en Filología Catalana no sea suficiente, para eximir de la realización de la prueba de conocimientos de la lengua valenciana, pues esa titulación avala sobradamente el conocimiento de la lengua de esta comunidad, denominada oficialmente "valenciana" en sus Estatuto de Autonomía y en el ámbito académico "catalán".

Asimismo, la sala señala que la literalidad de las convocatorias de la Conselleria "no es contraria a derecho pero sí lo es la exclusión o el silencio que en ellas se constata sobre la equivalencia que debe otorgarse a las titulaciones y certificados de filologia catalana y filologia valenciana.

Por su parte, STEPV-Iv recalcó hoy, en un comunicado, que esta sentencia se añade a la quincena de resoluciones del Tribunal Superior de Justicia valenciano que obliga a la Conselleria de Educación a reconocer esta titulación. "Pese a esto, la administración se ha negado reiteradamente a incluirla en las últimas convocatorias de oposición", lamentaron.

Igualmente, remarcan que este fallo es "muy importante y significativo", puesto que proviene del Tribunal Supremo, no admite recurso y obliga a la Conselleria a reconocer esta titulación en futuras convocatorias de oposiciones. Si la Generalitat no cumple esta sentencia, STEPV estudiará interponer un recurso contra el conseller de Educación por prevaricación, advirtieron.

Según el sindicato, las consecuencias jurídicas de esta sentencia son que el TS establece ya jurisprudencia en el reconocimiento del título de Filología Catalana como acreditación de valenciano y "veta" a la Generalitat la posibilidad de seguir dictando normas que ignoran esta equivalencia.

De hecho, recuerda, el Alto Tribunal "se había pronunciado ya a favor de la unidad de la lengua catalana y del reconocimiento del valenciano como parte de esta". No obstante, subrayan que esta es la primera sentencia del Tribunal Supremo español respecto del reconocimiento del título de Filología Catalana en las oposiciones a los cuerpos docentes no universitarios.

Recuerdan además que esta es la primera de las sentencias que la Generalitat "perdió ante el Tribunal Superior de Justicia valenciano y contra la cual presentó recurso que llega al Tribunal Supremo y pierde también".

STEPV considera también que del fallo se derivan consecuencias políticas, puesto que se "cierra totalmente" la posibilidad de secesionismo lingüístico legal; "pone al PP en rebeldía legal y al margen del respeto institucional si continúa aprobando legislación secesionista en el terreno lingüístico" y "demuestra a los ciudadanos que el PP utiliza las instituciones y la Justicia como campo de batalla ideológico".

"Cuánto dinero hemos pagado los contribuyentes por estas 20 sentencias que los gobernantes del PP han decidido ignorar, en tiempo y gastos de abogados y de jueces", se preguntan desde el sindicato.

STEPV anunció además su intención de impulsar un acuerdo de todos los sindicatos, entidades cívicas y partidos políticos para exigir al PP que "no se sitúe al margen de la ley y cumpla las sentencias de los tribunales y los dictámenes de la institución de la Generalitat de referencia lingüística, que es la Acadèmia Valenciana de la Llengua".

"El PP y el Gobierno valenciano tendrán que optar por el respeto a la legalidad y las instituciones o por quedar aislados en la anticatalanismo extremista y antiinstitucional", concluyeron.

El conflicto lingüístico en la Comunitat valenciana está más vivo que nunca, a pesar de que el PP se afanara en solucionarlo creando una academia de consenso, que ni soluciona nada ni consensúa sensibilidades: ES PROCATALANISTA SIN MÁS. El PP ha traicionado a los valencianos vendiéndonos al catalanismo importado y a los dogmas de fe fusterianistas. AVL DEROGACIO. LLENGUA VALENCIANA, MAI CATALANA.

Es una lastima pero asi es, mientras tengamos ese engendro de la AVL (Asociación Valencianos Lameculos), no podremos quitarnos el catalanismo de encima. Por eso hay que vaciar de poder la AVL para despues eliminarla y dejar la Real Academia de Cultura Valenciana como unico ente normalizador de nuestra lengua VALENCIANA.
